Please read these Terms & Conditions of Use ("Terms", "Agreement") carefully before using the website, mobile applications, interactive questionnaires, and automated document assembly software (collectively, the "Service") operated by Swabia Technologies, LLC ("we," "us," "our," or the "Company"). By accessing or creating an account within our platform, you agree to be bound by these Terms. If you do not agree to all of these terms, you are explicitly prohibited from using the Service.

  1. LEGAL DISCLAIMER & MANDATORY NOT-A-LAW-FIRM NOTICE

Swabia Technologies, LLC (DBA AVANZA Immigration Service) is not a law firm, does not practice law, and does not provide legal advice. • No Attorney-Client Relationship: Your use of the Service, conversational tools, software logic, checklist systems, or customer support channels does not establish an attorney-client relationship between you and the Company or any of its personnel. • Self-Help Software Platform Only: AVANZA Immigration Service provides automated software that populates standardized immigration forms (such as USCIS forms) based strictly on the raw data, responses, and selections you manually input into our interactive questionnaires. • Independent Representation: You are acting as your own representative. The software acts as an administrative translation and compilation tool; it is not a substitute for the customized legal strategy of a licensed immigration attorney. If you require legal advice, a strategy assessment for complex eligibility issues, or courtroom representation, you must consult with a licensed attorney or a DOJ-accredited representative.

  1. INDEPENDENT LEGAL REVIEW SERVICES (OPTIONAL)

• Independent Attorney Add-ons: Certain packages may offer an optional, independent legal review. If you select this add-on, your compiled packet will be routed to an independent, licensed immigration attorney who is not an employee or agent of Swabia Technologies, LLC. • Separate Scope: Any attorney-client relationship formed via this add-on is strictly limited to that independent attorney's review of your document packet for completeness and accuracy based on the information provided. The Company does not split legal fees with lawyers and receives no portion of any distinct legal fee charged by independent attorneys.

  1. GOVERNMENT FEES AND USCIS FILING RESPONSIBILITY

• Separation of Fees: All prices published on our platform represent software access and administrative preparation fees only. Our prices do not include mandatory government filing fees charged by the U.S. Citizenship and Immigration Services (USCIS), Department of State (DOS), National Visa Center (NVC), or local embassies. • Filing Accountability: Unless you purchase an explicitly designated comprehensive mailing service package, generating your completed forms does not constitute filing them. You remain solely responsible for reviewing the compiled packet for accuracy, signing the physical forms, attaching the required civil documents, enclosing the correct government check or payment form, and mailing the packet to the correct government filing address. • Processing Timelines: The Company has no control over U.S. government processing timelines, unexpected USCIS lockbox backlogs, policy shifts, or unexpected fee increases.

  1. ACCOUNT ELIGIBILITY AND ACCURACY DATA

• Eligibility: You must be at least 18 years of age and possess the legal capacity to enter into a binding contractual framework. • Absolute Truthfulness Mandatory: Under federal law (including 18 U.S.C. § 1001), submitting false or misleading information on immigration applications carries severe criminal and administrative penalties. You agree to provide strictly accurate, truthful, and complete information. Swabia Technologies, LLC reserves the right to immediately terminate any account if we detect fraudulent data entry, forged supporting documents, or bad-faith intent.

  1. REFUND POLICY & SATISFACTION GUARANTEES

• Standard Refund Matrix: Because our digital platforms generate customized, downloadable, and instantly exportable document packets upon questionnaire completion, fees are generally non-refundable once software processing has occurred. • USCIS Rejection Guarantee: If you purchase a package protected by our Approval/Acceptance Guarantee and your application is officially rejected or returned by USCIS due to a technical preparation error caused directly by our software code, we will issue a full refund of your package cost. This guarantee does not apply to rejections caused by user data entry errors, omissions of required civil documents, failure to pay government fees, missing deadlines, or subjective biometric/discretionary eligibility denials by a government officer.

  1. PROHIBITED PLATFORM EXPLOITATIONS

You agree that you will not use our Service to: • Engage in the Unlicensed Practice of Law (UPL): You may not use this platform to charge third parties for immigration document preparation services or operate an unauthorized immigration consultancy. • Automated Data Scraping: You may not copy, harvest, decompile, mirror, or reverse-engineer any proprietary questionnaire flows, algorithmic document-tagging pathways, or visual layout sheets. • System Misuse: You are barred from uploading attachments embedded with malicious malware, corrupted scripts, or files designed to disrupt our secure database architectures.

  1. LIMITATION OF LIABILITY & WARRANTY DISCLAIMER

• "As-Is" Blueprint: The Service is provided strictly on an "AS-IS" and "AS-AVAILABLE" footing. We make no warranties that using our platform will guarantee visa approval, green card issuance, or naturalization. • Liability Ceiling: To the maximum scale permitted by applicable law, Swabia Technologies, LLC shall not be liable for any indirect, consequential, punitive, or special damages, including application processing delays, missed filing windows, lost wages, or deportation risks. In no event shall our total aggregate liability exceed the actual dollar amount you paid to us to utilize the software tools.

  1. GOVERNING LAW & MANDATORY ARBITRATION

• Jurisdiction: These Terms shall be governed, interpreted, and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. • Dispute Resolution: Any claim, dispute, or legal friction arising out of your immigration software workflows or interactions with our support channels shall be settled via binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. • Waiver of Class Actions: All claims must be litigated strictly in your individual capacity. You explicitly waive your right to participate as a class representative or class member in any aggregated, consolidated, or representative legal proceeding.
